Artikel 61 legt de toestemmingsdrempel vast voor het testen van AI-systemen met een hoog risico onder reële omstandigheden krachtens artikel 60: niemand neemt deel zonder vrijelijk gegeven, geïnformeerde toestemming. Het vertaalt de logica van klinische proeven naar AI-tests.

- Toestemming wordt vóór elke deelname verkregen, na duidelijke en begrijpelijke informatie over aard, doelstellingen, voorwaarden, verwachte duur en de rechten van de proefpersoon
- De proefpersoon kan op elk moment weigeren of zich terugtrekken, zonder motivering en zonder nadeel
- De toestemming wordt gedateerd en gedocumenteerd; de proefpersoon of diens wettelijke vertegenwoordiger ontvangt een kopie
Nalevingstijdlijn
Van toepassing vanaf 2 augustus 2026; de Digitale Omnibus van 2026 stelde de materiële hoogrisicoverplichtingen uit (bijlage III naar 2 december 2027, bijlage I naar 2 augustus 2028) maar verplaatste deze bepaling niet.
