Článok 61 stanovuje prah súhlasu pre testovanie vysokorizikových systémov AI v reálnych podmienkach podľa článku 60: nikto sa nezúčastňuje bez slobodného informovaného súhlasu. Prenáša logiku klinických skúšok do testovania AI.

- Súhlas sa získava pred akoukoľvek účasťou, po jasnej a zrozumiteľnej informácii o povahe, cieľoch, podmienkach, predpokladanom trvaní a právach účastníka
- Účastník môže kedykoľvek odmietnuť alebo odstúpiť, bez zdôvodnenia a bez ujmy
- Súhlas je datovaný a zdokumentovaný; účastník alebo jeho zákonný zástupca dostane kópiu
Harmonogram súladu
Uplatňuje sa od 2. augusta 2026; digitálny omnibus 2026 odložil hmotnoprávne vysokorizikové povinnosti (prílohu III na 2. decembra 2027, prílohu I na 2. augusta 2028), ale toto ustanovenie neposunul.
