Artikel 94 is het kortste artikel van de handhavingsafdeling en draagt er de rechtsstaat in: GPAI-aanbieders onder de afdeling 5-bevoegdheden behouden de procedurele rechten van Verordening (EU) 2019/1020 — mutatis mutandis toegepast.

- Artikel 18 van Verordening (EU) 2019/1020 — de markttoezichtverordening — is mutatis mutandis van toepassing op aanbieders van AI-modellen voor algemeen gebruik
- In essentie: het recht te worden gehoord vóór bezwarende maatregelen, gemotiveerde besluiten en beschikbare rechtsmiddelen
- Deze waarborgen gelden onverminderd de specifiekere procedurele rechten in de AI-verordening zelf, zoals die in de artikelen 92 en 93
Nalevingstijdlijn
Van toepassing vanaf 2 augustus 2026; de Digitale Omnibus van 2026 stelde de materiële hoogrisicoverplichtingen uit (bijlage III naar 2 december 2027, bijlage I naar 2 augustus 2028) maar verplaatste deze bepaling niet.
