Članak 61. postavlja prag pristanka za testiranje visokorizičnih sustava umjetne inteligencije u stvarnim uvjetima prema članku 60.: nitko ne sudjeluje bez slobodno danog, informiranog pristanka. Prenosi logiku kliničkih ispitivanja u testiranje UI.

- Pristanak se datira i dokumentira; sudioniku ili njegovu zakonskom zastupniku uručuje se primjerak
Vremenski okvir usklađenosti
Primjenjuje se od 2. kolovoza 2026.; digitalni omnibus iz 2026. odgodio je materijalne visokorizične obveze (Prilog III. na 2. prosinca 2027., Prilog I. na 2. kolovoza 2028.), ali nije pomaknuo ovu odredbu.
