61 artikla asettaa suostumuskynnyksen suuririskisten tekoälyjärjestelmien testaamiselle tosielämän olosuhteissa 60 artiklan nojalla: kukaan ei osallistu ilman vapaaehtoista, tietoon perustuvaa suostumusta. Se siirtää kliinisten lääketutkimusten logiikan tekoälytestaukseen.

- Suostumus hankitaan ennen osallistumista, selkeän ja ymmärrettävän tiedon jälkeen testauksen luonteesta, tavoitteista, ehdoista, arvioidusta kestosta ja osallistujan oikeuksista
- Osallistuja voi kieltäytyä tai vetäytyä milloin tahansa, perustelematta ja ilman haittaa
- Suostumus päivätään ja dokumentoidaan; osallistuja tai hänen laillinen edustajansa saa jäljennöksen
Vaatimustenmukaisuuden aikataulu
Sovelletaan 2. elokuuta 2026 alkaen; vuoden 2026 digitaalinen omnibus lykkäsi aineelliset korkean riskin velvoitteet (liite III 2.12.2027, liite I 2.8.2028) mutta ei siirtänyt tätä säännöstä.
