Artikel 83 is de papierwerk-handhavingsclausule: ook zonder bewezen gevaar moeten een ontbrekende CE-markering, ontbrekende registratie of onbeschikbare technische documentatie worden gecorrigeerd — en bij aanhouden wordt het een marktbeperkingszaak.

- Dekt gebreken zoals CE-markering aangebracht in strijd met artikel 48 of niet aangebracht, ontbrekende EU-conformiteitsverklaring, ontbrekende registratie in de EU-databank, geen gemachtigde of onbeschikbare technische documentatie
- De markttoezichtautoriteit verlangt dat de aanbieder de non-conformiteit binnen de gestelde termijn beëindigt
- Houdt de non-conformiteit aan, dan neemt de lidstaat passende en evenredige maatregelen om het systeem te beperken of te verbieden, of terugroeping dan wel uitdehandelname te verzekeren
Nalevingstijdlijn
Van toepassing vanaf 2 augustus 2026; de Digitale Omnibus van 2026 stelde de materiële hoogrisicoverplichtingen uit (bijlage III naar 2 december 2027, bijlage I naar 2 augustus 2028) maar verplaatste deze bepaling niet.
