Artikel 82 behandelt het ongemakkelijke geval dat de conformiteitsmachine niet oplost: een AI-systeem dat aan de verordening voldoet en toch een risico vormt voor gezondheid, veiligheid of grondrechten. Conformiteit is geen schild wanneer reëel gevaar opduikt.
Samenvatting van de officiële tekst
- Vormt een conform hoog-risicosysteem toch een risico, dan verlangt de markttoezichtautoriteit van de operator alle passende maatregelen zodat het systeem dat risico niet langer vormt
- De operator zorgt voor corrigerende actie in de hele toeleveringsketen, binnen de gestelde termijn
- De lidstaat informeert onmiddellijk de Commissie en de andere lidstaten over risico en maatregelen; de Commissie overlegt en kan een vervolg op Unieniveau voorstellen
Nalevingstijdlijn
Van toepassing vanaf 2 augustus 2026; de Digitale Omnibus van 2026 stelde de materiële hoogrisicoverplichtingen uit (bijlage III naar 2 december 2027, bijlage I naar 2 augustus 2028) maar verplaatste deze bepaling niet.
