61 straipsnis nustato sutikimo ribą didelės rizikos DI sistemų bandymams realiomis sąlygomis pagal 60 straipsnį: niekas nedalyvauja be laisva valia duoto informuoto sutikimo. Jis perkelia klinikinių tyrimų logiką į DI bandymus.

- Sutikimas gaunamas prieš bet kokį dalyvavimą, po aiškios ir suprantamos informacijos apie bandymo pobūdį, tikslus, sąlygas, numatomą trukmę ir dalyvio teises
- Dalyvis gali atsisakyti ar pasitraukti bet kada, be pagrindimo ir be žalos
- Sutikimas datuojamas ir dokumentuojamas; dalyviui ar jo teisėtam atstovui įteikiama kopija
Atitikties tvarkaraštis
Taikoma nuo 2026 m. rugpjūčio 2 d.; 2026 m. skaitmeninis omnibusas atidėjo materialines didelės rizikos prievoles (III priedą — 2027 m. gruodžio 2 d., I priedą — 2028 m. rugpjūčio 2 d.), bet šios nuostatos neperkėlė.
