El artículo 61 fija el umbral de consentimiento para probar sistemas de IA de alto riesgo en condiciones reales conforme al artículo 60: nadie participa sin consentimiento libre e informado. Traslada la lógica de los ensayos clínicos a las pruebas de IA.

- El consentimiento se obtiene antes de cualquier participación, tras información clara y comprensible sobre la naturaleza, objetivos, condiciones, duración prevista y derechos del participante
- El participante puede negarse o retirarse en cualquier momento, sin justificación y sin perjuicio alguno
- El consentimiento se fecha y documenta, y se entrega copia al participante o a su representante legal
Calendario de cumplimiento
Se aplica desde el 2 de agosto de 2026; el Ómnibus Digital de 2026 aplazó las obligaciones sustantivas de alto riesgo (anexo III al 2 de diciembre de 2027, anexo I al 2 de agosto de 2028) pero no movió esta disposición.
