Articolul 61 stabilește pragul consimțământului pentru testarea sistemelor de IA cu risc ridicat în condiții reale în temeiul articolului 60: nimeni nu participă fără consimțământ liber și informat. Transpune logica studiilor clinice în testarea IA.

- Consimțământul se obține înaintea oricărei participări, după o informare clară și inteligibilă privind natura, obiectivele, condițiile, durata preconizată și drepturile participantului
- Participantul poate refuza sau se poate retrage oricând, fără justificare și fără vreun prejudiciu
- Consimțământul este datat și documentat; participantului sau reprezentantului său legal i se remite o copie
Calendarul conformității
Se aplică de la 2 august 2026; Omnibusul digital din 2026 a amânat obligațiile de fond cu risc ridicat (anexa III la 2 decembrie 2027, anexa I la 2 august 2028), dar nu a mutat această dispoziție.
