Artikel 79 is de vluchtstrook van het nationale markttoezicht: wat gebeurt er wanneer een AI-systeem op de markt een risico vormt voor gezondheid, veiligheid of grondrechten. Het choreografeert evaluatie, corrigerende maatregelen en zo nodig nationale maatregelen — met Uniebrede kennisgeving.
Samenvatting van de officiële tekst
- De markttoezichtautoriteit evalueert het AI-systeem wanneer zij voldoende reden heeft om zo'n risico aan te nemen, ook op signaal van de artikel 77-autoriteiten
- De betrokken operator neemt binnen de gestelde termijn alle passende corrigerende maatregelen — conform maken, uit de handel nemen of terugroepen
- Reikt de non-conformiteit verder dan het eigen grondgebied of blijft de operator in gebreke, dan neemt de autoriteit voorlopige maatregelen en stelt zij de Commissie en de andere lidstaten onverwijld in kennis
Nalevingstijdlijn
Van toepassing vanaf 2 augustus 2026; de Digitale Omnibus van 2026 stelde de materiële hoogrisicoverplichtingen uit (bijlage III naar 2 december 2027, bijlage I naar 2 augustus 2028) maar verplaatste deze bepaling niet.
