El artículo 52 — titulado oficialmente solo «Procedimiento» — regula cómo un modelo de IA de uso general pasa a ser formalmente, o impugna ser, un modelo con riesgo sistémico. Es la bisagra administrativa entre los criterios del artículo 51 y las obligaciones del artículo 55.
Resumen del texto oficial
- Notificar a la Comisión sin demora, a más tardar en dos semanas, desde que se cumple la condición del artículo 51 (presunción a partir de 10²⁵ FLOPs)
- El proveedor puede alegar que el modelo no presenta riesgo sistémico; la Comisión puede rechazarlo y designar el modelo, también de oficio
- La Comisión publica la lista de modelos designados; cabe reevaluación previa solicitud motivada
Calendario de cumplimiento
Aplicable desde el 2 de agosto de 2025, junto con el resto del marco GPAI; el Ómnibus Digital de 2026 no modificó esta fecha.
