El artículo 82 aborda el caso incómodo que la maquinaria de conformidad no resuelve: un sistema de IA conforme al Reglamento que aun así presenta un riesgo para la salud, la seguridad o los derechos fundamentales. La conformidad no es un escudo cuando aparece un peligro real.

- Cuando un sistema de alto riesgo conforme presenta no obstante un riesgo, la autoridad exige al operador todas las medidas apropiadas para que el sistema deje de presentarlo
- El operador garantiza la acción correctiva en toda la cadena de suministro, en el plazo prescrito
- El Estado miembro informa de inmediato a la Comisión y a los demás Estados, detallando el riesgo y las medidas; la Comisión consulta y puede proponer un seguimiento a escala de la Unión
Calendario de cumplimiento
Se aplica desde el 2 de agosto de 2026; el Ómnibus Digital de 2026 aplazó las obligaciones sustantivas de alto riesgo (anexo III al 2 de diciembre de 2027, anexo I al 2 de agosto de 2028) pero no movió esta disposición.
