Članak 82. pokriva neugodan slučaj koji stroj sukladnosti ne rješava: sustav umjetne inteligencije koji je u skladu s uredbom, a ipak predstavlja rizik za zdravlje, sigurnost ili temeljna prava. Sukladnost nije štit kad se pojavi stvarna opasnost.

- Kad sukladan visokorizičan sustav ipak predstavlja rizik, tijelo za nadzor tržišta zahtijeva od operatora sve odgovarajuće mjere kako sustav više ne bi predstavljao taj rizik
- Operator osigurava korektivne mjere duž cijelog opskrbnog lanca, u propisanom roku
- Država članica odmah obavješćuje Komisiju i ostale države, s pojedinostima o riziku i mjerama; Komisija se savjetuje i može predložiti daljnje korake na razini Unije
Vremenski okvir usklađenosti
Primjenjuje se od 2. kolovoza 2026.; digitalni omnibus iz 2026. odgodio je materijalne visokorizične obveze (Prilog III. na 2. prosinca 2027., Prilog I. na 2. kolovoza 2028.), ali nije pomaknuo ovu odredbu.
