Člen 82 pokriva neprijeten primer, ki ga stroj skladnosti ne reši: sistem UI, ki je skladen z uredbo, a vseeno predstavlja tveganje za zdravje, varnost ali temeljne pravice. Skladnost ni ščit, ko se pojavi resnična nevarnost.

- Država članica nemudoma obvesti Komisijo in druge države s podrobnostmi o tveganju in ukrepih; Komisija se posvetuje in lahko predlaga nadaljnje korake na ravni Unije

Uporablja se od 2. avgusta 2026; digitalni omnibus 2026 je preložil vsebinske obveznosti visokega tveganja (Prilogo III na 2. december 2027, Prilogo I na 2. avgust 2028), te določbe pa ni premaknil.
