Artikel 82 behandelt den unbequemen Fall, den die Konformitätsmaschinerie nicht lösen kann: ein KI-System, das dem Gesetz entspricht und dennoch ein Risiko für Gesundheit, Sicherheit oder Grundrechte darstellt. Konformität ist kein Haftungsschild, wenn reale Gefahr auftritt.

- Stellt ein konformes Hochrisiko-System dennoch ein Risiko dar, verlangt die Marktüberwachungsbehörde vom Akteur alle geeigneten Maßnahmen, damit das System dieses Risiko nicht mehr aufweist
- Der Akteur stellt Korrekturmaßnahmen entlang der gesamten Lieferkette sicher, binnen gesetzter Frist
- Der Mitgliedstaat unterrichtet unverzüglich Kommission und Mitgliedstaaten über Risiko und Maßnahmen; die Kommission konsultiert und kann Folgemaßnahmen auf Unionsebene vorschlagen
Compliance-Zeitplan
Gilt ab dem 2. August 2026; der Digital Omnibus 2026 verschob die materiellen Hochrisiko-Pflichten (Anhang III auf den 2. Dezember 2027, Anhang I auf den 2. August 2028), nicht aber diese Bestimmung.
