L'articolo 82 affronta il caso scomodo che la macchina della conformità non risolve: un sistema di IA conforme al regolamento che presenta comunque un rischio per la salute, la sicurezza o i diritti fondamentali. La conformità non è uno scudo quando compare un pericolo reale.

- Quando un sistema ad alto rischio conforme presenta comunque un rischio, l'autorità esige dall'operatore tutte le misure appropriate affinché il sistema non lo presenti più
- L'operatore garantisce l'azione correttiva lungo l'intera catena di fornitura, entro il termine prescritto
- Lo Stato membro informa immediatamente la Commissione e gli altri Stati, dettagliando rischio e misure; la Commissione consulta e può proporre un seguito a livello dell'Unione
Calendario di conformità
Si applica dal 2 agosto 2026; l'Omnibus digitale del 2026 ha rinviato gli obblighi sostanziali ad alto rischio (allegato III al 2 dicembre 2027, allegato I al 2 agosto 2028) ma non ha spostato questa disposizione.
