Članak 81. arbitar je nadzora tržišta UI: kad jedna država članica ograniči sustav umjetne inteligencije, a druga prigovori, Komisija odlučuje je li nacionalna mjera opravdana. Sprječava da dvadeset sedam nacionalnih postupaka proizvede dvadeset sedam različitih tržišta.

- Pokreće se kad se podnesu prigovori protiv nacionalne mjere iz članka 79. ili kad Komisija takvu mjeru smatra protivnom pravu Unije
- Komisija se savjetuje s dotičnom državom članicom i operatorom, ocjenjuje mjeru i odlučuje je li opravdana
- Opravdanu mjeru moraju slijediti sve države članice; neopravdanu mora povući država koja ju je donijela
Vremenski okvir usklađenosti
Primjenjuje se od 2. kolovoza 2026.; digitalni omnibus iz 2026. odgodio je materijalne visokorizične obveze (Prilog III. na 2. prosinca 2027., Prilog I. na 2. kolovoza 2028.), ali nije pomaknuo ovu odredbu.
