Článok 94 je najkratší článok oddielu presadzovania a vnáša doň právny štát: poskytovatelia GPAI podliehajúci právomociam oddielu 5 si zachovávajú procesné práva nariadenia (EÚ) 2019/1020 — uplatnené mutatis mutandis.

- Článok 18 nariadenia (EÚ) 2019/1020 — nariadenia o dohľade nad trhom — sa uplatňuje mutatis mutandis na poskytovateľov modelov AI na všeobecné účely
- V podstate: právo byť vypočutý pred nepriaznivými opatreniami, odôvodnené rozhodnutia a dostupné opravné prostriedky
- Tieto záruky platia bez toho, aby boli dotknuté špecifickejšie procesné práva samotného nariadenia o AI, ako tie vstavané do článkov 92 a 93
Harmonogram súladu
Uplatňuje sa od 2. augusta 2026; digitálny omnibus 2026 odložil hmotnoprávne vysokorizikové povinnosti (prílohu III na 2. decembra 2027, prílohu I na 2. augusta 2028), ale toto ustanovenie neposunul.
