Το άρθρο 100 απαντά σε ερώτημα που τα περισσότερα προγράμματα συμμόρφωσης δεν θέτουν ποτέ: ποιος επιβάλλει πρόστιμα στην ίδια την ΕΕ; Όταν θεσμικά όργανα, φορείς ή οργανισμοί της Ένωσης παραβιάζουν την πράξη ΤΝ, την πένα των προστίμων κρατά ο Ευρωπαίος Επόπτης Προστασίας Δεδομένων — σε σκόπιμα μικρότερη κλίμακα.

- Ο ΕΕΠΔ μπορεί να επιβάλλει διοικητικά πρόστιμα σε θεσμικά όργανα, φορείς και οργανισμούς της Ένωσης εντός του πεδίου της πράξης
- Ανώτατα όρια: έως 1 500 000 € για παραβάσεις των απαγορεύσεων του άρθρου 5· έως 750 000 € για άλλες μη συμμορφώσεις
- Τα πρόστιμα ακολουθούν τα κλασικά κριτήρια — φύση, βαρύτητα, διάρκεια, συνεργασία, προηγούμενες διαπιστώσεις — με δικαίωμα ακρόασης, δικαιοδοσία του Δικαστηρίου και έσοδα στον προϋπολογισμό της Ένωσης
