L'articolo 100 risponde a una domanda che la maggior parte dei programmi di conformità non pone mai: chi multa l'UE stessa? Quando istituzioni, organi o agenzie dell'Unione violano il regolamento IA, la penna sanzionatoria è del Garante europeo della protezione dei dati — su scala deliberatamente ridotta.

- Il GEPD può irrogare sanzioni amministrative alle istituzioni, agli organi e alle agenzie dell'Unione nel campo di applicazione del regolamento
- Massimali: fino a 1 500 000 € per violazioni dei divieti dell'articolo 5; fino a 750 000 € per gli altri inadempimenti
- Le sanzioni seguono i criteri classici — natura, gravità, durata, cooperazione, accertamenti precedenti — con diritto di essere ascoltati, competenza della Corte di giustizia e proventi al bilancio dell'Unione

Applicabile dal 2 agosto 2025, insieme al resto del quadro GPAI; l'Omnibus digitale del 2026 non ha modificato questa data.
