Článok 81 je rozhodcom dohľadu nad trhom AI: keď jeden členský štát obmedzí systém AI a iný namieta, Komisia rozhodne, či je vnútroštátne opatrenie odôvodnené. Bráni tomu, aby dvadsaťsedem vnútroštátnych postupov vytvorilo dvadsaťsedem rôznych trhov.

- Spúšťa sa pri námietkach proti vnútroštátnemu opatreniu podľa článku 79, alebo ak Komisia považuje také opatrenie za odporujúce právu Únie
- Komisia konzultuje s dotknutým členským štátom a prevádzkovateľom, opatrenie vyhodnotí a rozhodne o jeho odôvodnenosti
- Odôvodnené opatrenie musia nasledovať všetky členské štáty; neodôvodnené musí prijímajúci štát stiahnuť
Harmonogram súladu
Uplatňuje sa od 2. augusta 2026; digitálny omnibus 2026 odložil hmotnoprávne vysokorizikové povinnosti (prílohu III na 2. decembra 2027, prílohu I na 2. augusta 2028), ale toto ustanovenie neposunul.
