O artigo 81 é o árbitro da fiscalização do mercado de IA: quando um Estado-Membro restringe um sistema de IA e outro objeta, a Comissão decide se a medida nacional é justificada. Evita que vinte e sete procedimentos nacionais produzam vinte e sete mercados diferentes.

Calendário de conformidade
Aplica-se a partir de 2 de agosto de 2026; o Omnibus Digital de 2026 adiou as obrigações substantivas de alto risco (anexo III para 2 de dezembro de 2027, anexo I para 2 de agosto de 2028) mas não moveu esta disposição.
