Artikel 81 ist der Schiedsrichter der KI-Marktüberwachung: Beschränkt ein Mitgliedstaat ein KI-System und widerspricht ein anderer, entscheidet die Kommission über die Rechtfertigung der nationalen Maßnahme. So entstehen aus siebenundzwanzig nationalen Verfahren nicht siebenundzwanzig verschiedene Märkte.

- Ausgelöst durch Einwände gegen eine nationale Maßnahme nach Artikel 79 oder wenn die Kommission eine solche Maßnahme für unionsrechtswidrig hält
- Die Kommission konsultiert den betroffenen Mitgliedstaat und den Akteur, bewertet die Maßnahme und entscheidet über ihre Rechtfertigung
- Eine gerechtfertigte Maßnahme müssen alle Mitgliedstaaten befolgen; eine ungerechtfertigte muss der handelnde Staat zurücknehmen
Compliance-Zeitplan
Gilt ab dem 2. August 2026; der Digital Omnibus 2026 verschob die materiellen Hochrisiko-Pflichten (Anhang III auf den 2. Dezember 2027, Anhang I auf den 2. August 2028), nicht aber diese Bestimmung.
