O artigo 90 liga uma campainha de alarme direta da ciência à execução: o painel científico de peritos independentes pode alertar formalmente o Serviço para a IA quando suspeite de um risco sistémico — ou de um modelo que devia ter sido designado e não foi.

- O painel científico pode emitir um alerta qualificado quando tenha razões para suspeitar de um risco concreto identificável a nível da União proveniente de um modelo GPAI, ou de que um modelo preenche as condições do artigo 51 sem ter sido classificado
- Perante um alerta qualificado, a Comissão, através do Serviço para a IA, pode exercer os poderes da secção 5 — pedidos de documentação, avaliações, medidas
- O fornecedor em causa é informado; o alerta torna a ciência independente um gatilho formal de execução, não mero conselho
Calendário de conformidade
Aplica-se a partir de 2 de agosto de 2026; o Omnibus Digital de 2026 adiou as obrigações substantivas de alto risco (anexo III para 2 de dezembro de 2027, anexo I para 2 de agosto de 2028) mas não moveu esta disposição.
