Articolul 81 este arbitrul supravegherii pieței IA: când un stat membru restricționează un sistem de IA și altul obiectează, Comisia decide dacă măsura națională este justificată. Împiedică douăzeci și șapte de proceduri naționale să producă douăzeci și șapte de piețe diferite.

- Declanșată când se ridică obiecții contra unei măsuri naționale luate în temeiul articolului 79, sau când Comisia consideră o asemenea măsură contrară dreptului Uniunii
- Comisia consultă statul membru vizat și operatorul, evaluează măsura și decide dacă este justificată
- O măsură justificată trebuie urmată de toate statele membre; una nejustificată trebuie retrasă de statul care a luat-o
Calendarul conformității
Se aplică de la 2 august 2026; Omnibusul digital din 2026 a amânat obligațiile de fond cu risc ridicat (anexa III la 2 decembrie 2027, anexa I la 2 august 2028), dar nu a mutat această dispoziție.
