81 artikla on tekoälyn markkinavalvonnan erotuomari: kun yksi jäsenvaltio rajoittaa tekoälyjärjestelmää ja toinen vastustaa, komissio ratkaisee, onko kansallinen toimenpide oikeutettu. Se estää sen, että kaksikymmentäseitsemän kansallista menettelyä tuottaisi kaksikymmentäseitsemän eri markkinaa.

- Käynnistyy, kun 79 artiklan nojalla toteutettua kansallista toimenpidettä vastustetaan tai komissio pitää sitä unionin oikeuden vastaisena
- Komissio kuulee asianomaista jäsenvaltiota ja toimijaa, arvioi toimenpiteen ja päättää sen oikeutuksesta
- Oikeutettua toimenpidettä on kaikkien jäsenvaltioiden noudatettava; perusteeton on toteuttaneen valtion peruutettava
Vaatimustenmukaisuuden aikataulu
Sovelletaan 2. elokuuta 2026 alkaen; vuoden 2026 digitaalinen omnibus lykkäsi aineelliset korkean riskin velvoitteet (liite III 2.12.2027, liite I 2.8.2028) mutta ei siirtänyt tätä säännöstä.
