Artikel 91 ist die erste Sprosse der GPAI-Durchsetzungsleiter der Kommission: die Befugnis, die Unterlagen einzufordern. Die technische Dokumentation der Artikel 53 und 55 existiert, um vorlegbar zu sein — diese Bestimmung stellt das auf die Probe.
Zusammenfassung des offiziellen Textes
- Die Kommission kann von einem GPAI-Anbieter die nach den Artikeln 53 und 55 erstellte Dokumentation oder zusätzliche Informationen verlangen, die zur Konformitätsbewertung nötig sind
- Auch das KI-Gremium kann die Kommission auf begründeten Antrag ersuchen, eine solche Anforderung auszulösen
- Anforderungen setzen eine Frist; der Anbieter — oder sein Bevollmächtigter — muss liefern, und unrichtige oder unvollständige Antworten sind eigenständig bußgeldbewehrt
Compliance-Zeitplan
Gilt ab dem 2. August 2026; der Digital Omnibus 2026 verschob die materiellen Hochrisiko-Pflichten (Anhang III auf den 2. Dezember 2027, Anhang I auf den 2. August 2028), nicht aber diese Bestimmung.
