EU AI Act compliance deadlines — updated for Digital Omnibus 2026

The Digital Omnibus 2026 extended two key deadlines. The table below reflects current law.

Finding your deadline

Prohibited practices (Art. 5): Already in force since 2 February 2025. If you are using social scoring, real-time biometric identification in public spaces for law enforcement (without exceptions), subliminal manipulation systems, or other prohibited AI — you are already out of compliance. Stop use immediately.

GPAI providers: Obligations under Chapter V have applied since 2 August 2025. If you provide a GPAI model and have not yet implemented technical documentation and copyright summaries, you are currently non-compliant.

Annex III systems: You have until 2 December 2027, but notified body queues and harmonised standard availability mean that preparation should begin now. Use the Compliance Checklist →

Annex I systems: The 2 August 2028 deadline reflects the additional complexity of coordinating AI Act conformity assessment with your existing product safety certification. Engage your notified body early — capacity is limited.

Yes. The Digital Omnibus 2026 extended the Annex III deadline from 2 August 2026 to 2 December 2027 (16 months extension) and the Annex I deadline from 2 August 2026 to 2 August 2028 (24 months extension). The GPAI deadline (2 August 2025) and prohibited practices deadline (2 February 2025) were not extended.

After the deadline, placing a non-compliant high-risk AI system on the EU market is prohibited. Systems already on the market before the deadline may have a transitional period, but new placements must comply. Fines of up to €15M or 3% of global annual revenue apply for high-risk non-compliance.
